i have this 60 guy on my academy

instead of graduate by himself, he wants me to kick him out of academy or else he won't leave

Do i get any penalty for kicking out a guy like him?

If s/he is already lvl 60, you can kick him/her out without penalty.

Yup, its normally just a 24hr perioud of inability to recruit. There might be something about reputation, but I cant confirm this.

They dont have to leave once they hit 60. They could stay until lvl 80, if they so prefer.

Ehm... If you have Graduate button near his name ( at the same line ) just graduate him. It wont give you any penalty. But if you dont have that button so just kick him =\ Why do you have to suffer?
