thanks for everyones suggestions. i did end up tweaking the settings a bit more. unfortunately the manual is a worthless POS. the menu is a bit too basic so there wasnt much you can mess around with. luckily i did end up fixing all the problems, thank god cuz i dont wanna lug that thing back. i still have less than 3 weeks to return it if i notice the problems again but hopefully i fixed it for good.

edit: ended up calling toshiba tech support. they told me it was malfunctioned and to return/exchange it. we went back to best buy and ended up getting a new samsung instead since they were on sale and i had an additional 10% off due to using my mastercard
